Hello Karen. Thank you for contacting us. We have received the complaint you submitted against Drive Now. We will contact them and ask that they address the allegations in the complaint. As soon as we receive their reply, we will send it to your email. Since there is a dispute regarding the amount of the down payment, I recommend you gather all paperwork you have regarding the sale of the vehicle and review the terms. Further action on your part may be necessary, so it’s wise to review the contract terms regarding the down payment, warranty, condition of vehicle, etc.

To answer your question, I did some research and a voluntary repossession is defined as taking your vehicle back to the lender or dealership before they send the repo man for it, that’s called voluntary repossession.

It is important to know that a voluntary repossession will have a big impact on your credit score. It is recommended that you completely understand the terms when you make the voluntary surrender. If there is a balance left over, it could be turned over to a collection agency.

I am including a link to our Resource Guide on Used Car Buyers Bill of Rights: https://www.checkbca.org/tips/auto/used-car-buyers-bill-of-rights-159 Our guides do pertain to California law, but do contain information and tips that our readers from other states may find helpful. I do recommend you check the laws pertaining to used car purchases in your state.

I hope this information has been helpful. Please feel free to contact me directly at vantillon@checkbca.org if I can be of further assistance.
