I own a new air conditioning business and want to post photos of my past work when I was working with the competition

Date: 4/13/2019 9:57 AM (PST)

Is it illegal for me to post photos that I took and shared with my old boss so he can have for his portfolio of his company even if I did the work and took the photos. He warned me and said that I better not post the pictures I took while working for him. I want to show off my work

Hello Edward. Thank you for your question. Unfortunately, I do believe the photos you took while under the employment of your former employer, belong to them, even if you were the photographer. The situation may be different, if an agreement was signed prior to the photos being taken and uploaded on their portfolio, stipulating that you own the rights to the photos. So sadly, I believe the company now owns the images.

To be certain, I believe it may worth your time and effort to consult with an attorney. An attorney would be able to answer any questions you have regarding any legal rights you have to the images and prevent you from violating copyright laws that you may not be aware of.

Thank you again for your question. I can be reached directly at vantillon@checkbca.org if I can be of further assistance.

Hello Edward. I would like to share with you that if you own the photos, you have the right to use them unless you signed an exclusivity clause that the owner has the rights to photos on your jobs. Another concern involves the owner of the homes you did the work for. I would check with an attorney to see if you need the homeowner's permission to post the photos because the work was performed on their home.
