Towing Company Fraud

IMy vehicle was impounded on 9/19/17 at Mike's Towing Company in Soledad CA my car allegedly we as stolen from the yard on9/20/17. I personally went to inquiry about release of liability to the towing yard on9/25/17. on or aprox 10:00 am the employee gave me a scratch paper with the amount of money I would still have to pay the business to release liability. I told him that I would be returning to pay fees and sign the liability document. On 9/26/17 I received a call from Soledad PD Officer accusing me of GTA on my own vehicle which the Towing Company reports stolen precisely on 9/26/17 after noon 6 plus days after the GTA occurred. I am looking for help with this matter please

Hi Alicia, thank you for your ATE post. Your complaint against Mike’s Towing has been processed and forwarded to the company for a response. As soon as we receive a response from Mike’s Towing you will be notified. The company will be made aware of your complaint, your requested resolution, and will be given the opportunity to respond. However, because of the allegations of GTA and the allegations of GTA against you, you may have to end up going to Small Claims Court. It may be wise to start looking for legal counsel with expertise in towing law.

When a vehicle is towed the tow company must notify law enforcement it has your vehicle and is in transit to a storage facility. When you claim your vehicle, before paying anything you must be given a copy of the written authorization the tow truck received to tow your vehicle. You can request a Towing Fees and Access Notice which list your rights, including your rights to receive an itemized invoice of charges. You should always request this notice and an itemized invoice. To pursue a wrongful tow claim, you most likely will need to go to Small Claims Court.

Tow truck drivers are required to have a current and valid DMV Motor Carrier Permit and Class B Commercial Driver’s License. Here is the link to the DMV Active Carrier List: The company’s website, does provide a list of their towing fees here:
