Haz mat violations

Date: 11/22/2020 8:55 PM (PST)

Can a company be sued for not adhering to federal regulation laws concerning hazardous materials that are supposed to be destroyed and wasn’t for instead their greedy asses resold for more profit to liquidation company which i bought a pallet from unknowing that most of those items contained on my pallet were mostly returns from Walmart, cvs, Walgreens, PetSafe etc and once I had unloaded all the items to begin making sure they worked, weren’t broken or missing parts etc. I started coming across receipts attached to the items where as from the company’s own service departments had attached them to the return item themselves and wrote on these receipts the letters HAZ MAT and then also on receipts under disposition it stated DESTROY!! So then , I began to look into that for I didn’t at the time know what haz mat was or stood for but quickly found out and was totally disgusted by these companies lack of responsibility and also total disregard of the federal laws and guidelines/practices they are legally required to abide by for instead of them following and adhering to such laws/guidelines/practices they blatantly did not and instead resold these haz mat items to a liquidation company which is how come I now have these haz mat items in my home and have been unable to get these companies to refund the amounts of items costs which has set me back quite a bit for I paid a lot of money for that electronics pallet and had hoped to not only make my money I paid for it back but also possibly some extra for I’m disabled and live off of very little income so I feel I was not only frauded but also put in potential harmful to myself and my family and animals situation for I still have haz mat items stored in my room at my moms house where I live with a sister , elderly mother and 10 cats! I feel like these companies need to be held accountable and should be fined and also exposed to the public etc for their greed and total disregard for their customers and customers families , friends, pets etc health and well being! I want to sue them for they’ve caused me extreme mental anguish and also have cost me a lot of money I didn’t have to just throw away!! Please let me know if by law I can sue or not for when I’ve attempted to take items back to these stores for refund they deny me as well as attempt to make me feel like I’ve done something wrong when it is actually indeed them who has !!

Hello Rhonda. Thank you for your inquiry. In West Virginia, citizen complaints involving hazardous waste should be reported to the West Virginia Department of Environmental Protection: https://dep.wv.gov/WWE/ee/hw/Pages/default.aspx

You can register a citizen complaint here: https://dep.wv.gov/WWE/ee/geninfo/Pages/complaints.aspx

Thanks for the contact information but you still never answered my question concerning wether or not those companies who have broken federal haz mat laws by reselling haz mat items to public can be sued by someone who was unaware when purchased items from a liquidation company that these items were on pallet ?? Please let me know ASAP & I Thank you very much!

Hello Rhonda. Please contact an attorney. Only an attorney unequivocally would be able to tell you if you have grounds to pursue a lawsuit. However, I will suggest that in your search for an attorney you find one well-versed in toxic materials and hazardous waste laws.
