Hi my name's Dennis I bought a 3 wheel trike moped used from impact Motorsports. It has a 3 month warranty I been having issues with it since I got it and the warranty still has half a month on it. They order a part for me I called once a week and they said it hasn't been delivered. When I called on the 3rd week they told me that the manufacturer emailed them saying that they didn't make that part. So I called jim another dealer who sells ice bear trikes. And he told me they are giving me the run around and that he can get that part and that my moped shouldn't be stalling and not working when I have a half a tank etc. So Jim ordered the part for me and delivered it to impact motorsports. I had my uncle look at my moped and he noticed alot of stuff wrong with it. We went to impact motorsports and as soon as they seen my uncle walk in with me there smiles went upside down. He started telling them everything wrong with it and what it was mssing. In a regular non aggrassive matter and they guy got extremely defensive raising his voice saying that my uncle is verbally attacking him. Which is totally not true I was right there next to him. Then he told me I bought the moped as is and he didn't even have to give me a warranty etc. Which was a lie nothing on my paperwork says anything about as is. Or has the words as is on it. All it says is manufacturer 3 month parts only standard warranty. He then started threaten to refuse service to me. Then he decided to cone outside so my icle could show him all that is wrong. He got extremely defensive again. And then yelled take your moped and go home and stormed off my uncle went inside his truck I went back inside and told him what was wrong he said he would fix it.a week later I came to get it my winshield plastics where broke the idle was extremely low and I had to give it throttle to start it and keep teething it to keep it started. He told me that moped and the type of engine in it was suppose to stall at redlights and stops signs. Which was a lie but I agreed with him and he said his mechanics put 11 hours into it tearing it from bottom top down and that it is in perfect condition. I drove it home about a mile out it started back firing I pulled over. And adjusted the idle so I wouldn't stall on me it still did. I went to work the next day. I got off and there was a huge gas puddle under my moped so I filled it up. And took it to Jim the other dealer he looked at it and is now fixing it properly. He said they put the wrong fuel tube on it so it was leaking gas and that they broke my plastic installing the digital speedometer. And forgot to attach a bolt that connects the muffler to the engine which cause a gas leak inside it making it backfire. And they forgot to attach a tube thing from something to the carb and he's looking into everything else they did wrong. Can I sue and get my money back ? Or can I have them pay Jim who is fixing it correctly they way it should be ? Please help I got all the papers
