You retained our office in 2018, approximately 4.5 years ago. You paid your fees in full in November 2019. The documents we provided to you do not state that "nothing would be done until" you paid in full. In fact, what the documents say is "It is understood that we will begin the preparation of your petition immediately, take your phone calls and those of your creditors, but we will not actually file your case until we have been paid in full." This is what we did. I reviewed your file and there were 35 attempts, by phone, text and email, to get you to submit documents to complete your case. In fact, several times you submitted partial documents which were worked. Because of the partial submissions, your income had to be updated 10 times. On June 19, 2020, you had a phone signing with my office in which we completed most of your case but told you there were a few things remaining for you to get done prior to filing. Namely, the required prefiling credit counseling course. We never received that document. The case soon grew stale as you did not submit the documents we requested. There were 9 attempts to contact you after that, all went unanswered. By the time we closed your file, for lack of communication, we had been your attorney for over 4 years, and you had been nonresponsive for over 2 years.
The good news, however, is that California has a statute of limitations that is 4 years. As long as you did not incur, or pay on, any of the debt since retaining our firm, your creditors are barred from suing you at this point. In other words, we have held them off long enough that you no longer need a bankruptcy. When we reviewed your work to close the file we created a detailed billing statement, which you have a copy of, that shows all the work done on your case. It also shows that the fees you agreed to over four years ago were earned by all the work we did to get your case prepared (multiple times) and trying to get you to timely provide documents.
At this point I recommend you focus on cleaning up your credit. I tried to call you today to discuss this but, once again, was unable to reach you.
