Agency: California Bureau of Real Estate ~Description:

~ On July 14 2014 the California Bureau of Real Estate (“BRE”) filed a Desist and Refrain Order against HRS & Associates using the name Home Retention Solutions (“HRS”) Noel Ramos (“Ramos”) and Gerald Castaneda (“Castaneda”). Based on the investigation the BRE determined that HRS Ramos and Castaneda had engaged in acts or practices in violation of the California Code of Regulations and the California Business and Professions Code. The violations include but were not limited to: performing acts which require a real estate broker license advertising and/or assuming to act as a real estate broker; advertising and charging demanding or collecting advanced fees for loan medication services.

~ According to the BRE these acts were performed during a period of time when HRS Castaneda and Ramos were not licensed by the BRE as real estate brokers.  The Desist and Refrain Order prohibits HRS & Associates Noel Ramos and Gerald Castaneda whether doing business under their own names or any other names or fictitious names from performing any acts within the State of California for which a real estate broker license is required as defined in California Business and Professions Code.

Comments and Analysis

Effective October, 2009 in California, it is illegal to collect any fees, regardless of the form, for negotiating or attempting to negotiate a loan modification for a residential mortgage. All modification services must be fully completed before any money can be collected. It is also illegal to divide fees or services into components for the purpose of avoiding this law.

HUD approved housing counseling agencies are exempt from this law. For businesses outside of California, please check with the agency that regulates this industry.
