In the case of Mr. Boulware, we have investigated this matter with the full cooperation of the franchise-owned Byrider. Mr. Boulware filed a complaint regarding the mechanical issues he has experienced since purchase. Mr. Boulware purchased a 2016 Jeep Grand Cherokee on October 16, 2023 from the franchise-owned Byrider location on South Boulevard in Charlotte, North Carolina. The vehicle is covered by a 24-month service agreement. While we understand that dealing with any service issue may be frustrating, a pre-owned vehicle, like any other mechanical device with moving parts, will require routine maintenance and periodic repairs to ensure its continued use. This morning, Mr. Boulware arrived at our premises to discuss his concerns. The Operations Manager personally approached him as he has previously purchased a couple of vehicles from us. Upon investigation, we discovered that the customer has been parking his vehicle on a steep incline in the evenings, which is causing difficulty in shifting the vehicle out of park. The Operations Manager provided him with the advice to engage the parking brake before putting the vehicle in park, in order to alleviate stress on the driveline. By relying on the E-Brake to hold the vehicle, we are confident that this solution will effectively resolve his issue. We did however, diagnose a check engine light while he was here and discovered that a coil clip was not properly secured and was causing the engine to misfire. We secured the clip and topped off the oil at no cost to Mr. Boulware. Byrider strives to achieve the satisfaction of every customer. We apologize for any inconvenience the mechanical issues have caused, and we value Mr. Boulware as a customer. We look forward to our continued relationship.

Customer Complaint

So I made a complaint about my car & the car lot a couple days ago, well today while I was at work the car lot has my car repossessed & when I asked what for they said I have not made my payments & I have bank statement proof that I have made all payments on time and have never missed a payment. They told me to clean my car out and take my plates off & I was stuck at work due to them taking my car. They wrote up a fake repossession paper so I called the police and they said they couldn't stop them because of the paper and it is between me and the loan company CNAC. They also blocked me from the business page & blocked my phone number. Now they will report to credit a repossession that is illegal Resolution Sought Give me my money back that I have paid thus far on the vehicle and take it off of my credit report

Regarding Mr. Ryerson, complaint, we conducted a thorough investigation with the full cooperation of the franchise-owned CNAC. Mr. Ryerson is dissatisfied with how the vehicle repossession was handled. On December 29, 2023 Mr. Ryerson purchased a 2016 Ford Fusion from the franchise-owned Byrider location atBishop Avenue in Rolla, Missouri. The purchase was secured by a retail installment contract. Full coverage collateral insurance is a requirement of the retail contract. Mr. Ryerson defaulted on their retail contract, when he failed to meet the insurance requirements. The vehicle was repossessed. All required forms and letters were sent to the address on file. CNAC has written policies and procedures in place to ensure every repossession complies with federal and state regulations. This includes providing the debtor with a written explanation of their rights and responsibilities after the repossession. At CNAC, our goal is to provide the highest level of satisfaction to every customer. While we understand Mr. Ryerson's situation, he did default on his/her retail contract. As a gesture of goodwill. CNAC has agreed to release Mr. Ryerson from his contractual obligation and remove the tradeline from the credit reporting agencies on the next reporting period.

Customer Rebuttal

I have never received any notice nor letter from CNAC stating that the car was being repossessed or the right to cure. I was never given any warning. They simply showed up and took the car. As a business they should offer my money back for the car and take it off of my credit. I will be in contact with higher people in results to get my money back or further more. If they would give me the money back I have paid for the vehicle thus far I would be satisfied as well as taking it off my credit. But they will not. So I will take a step further in getting my money back at this time.

Company Final Response

3/25/2024

We stand behind our initial response. Mr. Ryerson's default was due to the insurance requirements. which does not require prior notification as it is a condition of the retail agreement."
