Description:

On April 2, 2014 the Federal Trade Commission ("FTC") filed a Complaint against Jerk, LLC, dba Jerk.com ("Jerk.com") and John Fanning ("Fanning"). Based on the investigation, the FTC charges that Jerk.com and Fanning violated provisions of the FTC Act by misleading consumers that the content on Jerk.com had been created by other Jerk.com users, when in fact most of it had been gathered from Facebook. The profiles also included millions of photos, including photos of children and photos that consumers claim they had tagged on Facebook as private. The FTC further charges that Jerk.com and Fanning falsely lead consumers to believe that by paying for a Jerk.com membership, they could access premium features that would allow them to change their "Jerk" profile. According to the FTC, in many cases, consumers who paid the subscription fee often got nothing in return.

The FTC Order prohibits Jerk.com, Fanning, and all their officers from misrepresenting membership benefits and the source of content on a website, misrepresenting compliance with a company's user agreements, privacy policy, or contract provisions. The FTC further Orders that Jerk.com and Fanning are permanently restrained from disclosing, using, selling, or benefiting from customer information.

The issuance of the FTC Complaint marks the beginning of a proceeding in which the allegations will be tried in a formal hearing before an administrative law judge.
