Complainants allege the company sends out misleading solicitations designed to appear as if they are receiving a bill from an official records office or that it is necessary to pay $89 to purchase a copy of their grant deed. Some complainants state the documents received could have been found by performing a simple search listed inaccurate information or could be obtained from a local government source for free or a nominal fee.~~The company responds by disputing that the mailers are misleading and pointing out that they are a legitimate business that provides a copy of their Deed a detailed Property Profile or other Record of Title service. They state that they do display required disclaimers that they are not associated with the government and clearly indicate that the letter is a solicitation and not a bill. The company has issued refunds upon request when customers accept their offer and services are completed.~

This company and others that conduct business similarly are not part of the Government and are not acting on behalf of any government agency. Property grant deeds confirm the ownership of a home or property and are mailed to new homeowners after a purchase is finalized. These deeds are usually required only during transactions such as home loan refinancing transactions to obtain a home insurance policy or a sale. If you are selling your home your real estate agent will take care of obtaining the certified grant deed for you. You do not have to use these private companies to obtain copies of the deed or other public records. Although it is suggested that property owners have a copy of the deed the urgency to obtain one is greatly over exaggerated by these types of companies. You can obtain a copy of a deed or recorded document at any time by contacting your local Recorder’s Office for free or for a nominal fee. ~~It is against U.S. Postal Service regulations to mail a bill or invoice that is actually a solicitation unless it bears a clear disclaimer that such unsolicited invoice is for information only and not a request to pay. The best protection against phony invoices is knowledge and vigilance. Be on the lookout for disguised solicitations. Carefully review invoices from companies which you do not normally do business; establish effective internal controls for the payment of invoices and verify all invoices with the person who gave authorization. ~~Some solicitations could violate the law if they misrepresent information.
