Created a fraudulent loan Ponzi scam using my name with no origination of mortgage or affiliation of any kind to the estate property i inherited from my father who had a loan an satisfied the loan acknowledged by the Loan Service his name is still on the title my name added 2007 after the satisfaction the LLC had a foreclosure proceeding deeding the estate property to another LLC using a referee deed now bringing me to landlord tenant court trying to put me out of my property Resolution Sought Stop the false practices of Ponzi scams,and stealing estate properties from unaware heirs

Our review of the records indicate that the account was originated on April 20, 2007 with IndyMac Bank a federally chartered bank with an original balance of $392000. As advised in our previous response only Ms. Gary signed the fixed adjustable rate note. However, both Ms. Gary and Mr. Morales signed the mortgage which means both have an interest in the property. Ocwen acquired servicing of the account effective August 16, 2013, at which time the account was past due for the March 1, 2011, payment with an unpaid principal balance of $375837.70 the account had been referred to foreclose in October 2011 by IndyMac, a division of One West Bank prior to Ocwen's acquisition of the account. The account remained in foreclosure for the duration of time that Ocwen serviced the account. On November 15, 2018 the servicing of the account was transferred from Ocwen to Shellpoint Mortgage and the Notice of servicing transfer dated October 29 2018 which confirms transfer of the account from Ocwen to Shellpoint Mortgage Servicing. As PHH is no longer servicing the account we are unable to offer any further assistance we recommend Ms. Gary to contact the current servicer for any questions regarding the current status of the account.

I financed a home in 2012 and experienced a hardship. I had some late payments directly because of the hardship and after being able to get the home repaired, I put the house on the market and sold it. The loan was paid in full. In December 2021, I contracted on 4 acres of land with a pond to have a custom home built and lost that due to credit. I later contracted on a 4 bedroom home and lost that as well on March 23rd. The lender stated she received an alert stating to "Proceed with Caution" and it had something to due with Ocwen Mortgage. I soon found out this mortgage company has black balled me to keep me from purchasing another property and I am unable to get a conventional loan for another three years. I have asked the company to remove this due to circumstances of my hardship and they have refused. I believe I am being discriminated against as being African American and female. I would like to know how many other consumers are black balled in this manner and what is the ratio with race and sex? Resolution Sought I would like for the business to move this completely off of my credit report. This was paid in full and needs to be removed.

I talked with Dan Mann with PHH Mortgage -previously Ocwen Mortgage and I was informed this would be removed if I could prove there was fraud involved. I emailed several pieces of documents to show that and after waiting it was rejected. One document was paperwork from an attorney who was representing me at the time that had "Constructive Fraud" included. I also submitted paperwork from the city of Charlotte showing where I requested permits in the order to get the house up to code. I will be more than willing to provide this paperwork to you as well. At this time I have lost two properties because of this and my daughter have been unable to relocate due to negligence of the mortgage company. (Personal info sent to BBB File)

In the correspondence, Ms. Harrison indicated the presence of fraudulent activity on the account and requested to investigate the same. The Note and Mortgage, which reflect that the account was originated on March 28, 2012, with Ally Bank Corp, with an original principal balance of $121831.00. Because PHH was not involved in the origination of the loan, we cannot comment on issues regarding the origination of the loan. Ocwen acquired servicing of the account effective 9/30/14, at which time the account was due for the 9/1/14 payment. Our review of the Ocwen's records indicate that the foreclosure proceedings were initiated on 11/6/17, as the account was past due for the 7/1/17; however, the foreclosure proceedings were stopped as the account was paid in full on 1/10/18. Further, we are unable to determine the specific issues surrounding you concerns; therefore, we recommend you to please be specific with the concerns so that we may research the matter further, and respond to you as appropriate.
