Complainants allege they purchase certificates for free gas and receive nothing back from the company. Other complaints filed by distributors also allege the company fails to send gas certificates and discount coupons as agreed. Some buyers complain they received a letter from an attorney who advised them the terms of the offer had substantially changed due to financial restructuring within the company. Complainants who did not agree with the new terms and conditions requested refunds.~~The company responded to most complaints by offering refunds. Some complainants disputed that they had actually received a refund. This company is a promotional marketing company offering work at home opportunites through a social networking site called People String." Those who invest in a distributorship purportedly earn money selling gas or discount cards and recruiting others to do the same. Distributors who recruit other distributors are said to earn a percentaage of each new recruit.~~Our experience with similar offers has been that earnings claims are exaggerated at best affiliates are not paid as agreed and in some cases the companies fail to disclose total costs involved for website development or purchasing up-line positions. Although there are some legitimate multi-level sales companies many such companies engage in pyramid marketing tactics. Make sure you are aware of the differences. A legitimate multi level plan encourages successful distributors to recruit and train a sales force but the distributor must also assume ongoing wholesaling and managing responsibilities as well as selling to their own retail customers. Emphasis should be placed on selling the product or services offered as a means to earn money not recruiting others. In an illegal pyramid the recruits on the bottom level pay money to a few people at the top. They generally do not publicly advertise their offer but instead rely on word of mouth recruitment of new affiliates. They may hold recruitment meetings where they create a frenzied and enthusiastic atmosphere where group pressure and promises of easy money prey on people's greed and fear of missing out on a good deal. Some pyramids are easily recognizable and are as simple as a chain letter. Others are very sophisticated and disguised to look like legitimate multi-level marketing companies to fool investors and law enforcement. As their disguise they may take on a line of products or a service and claim to be in the business of selling to consumers. When in reality the real money comes from recruiting and not from marketing the products. Recruits themselves run a significant risk of arrest and fines by authorities for participating or promoting such offers.~~~

Other Considerations

California Penal Code Sec. 327 for chain marketing schemes. It reads as Follows:~~Every person who contrives prepares sets up proposes or operates any endless chain is guilty of a public offense and is punishable by imprisonment in the county jail not exceeding one year or in state prison for 16 months two or three years. As used in this section an "endless chain" means any scheme for the disposal or distribution of property whereby a participant pays a valuable consideration for the chance to receive compensation for introducing one or more additional persons into participation in the scheme or for the chance to receive compensation when a person introduced by the participant introduces a new participant. Compensation as used in this section does not mean or include payment based upon sales made to persons who are not participants in the scheme and who are not purchasing in order to participate in the scheme.~
