Description:

On April 13, 2015, the Colorado Supreme Court (“CSC”) filed an Order against Danny Fish (“Fish”), individually and doing business as, Colorado Paralegal Services, Inc. (“CPSI”). Based on the investigation, the CSC determined that Fish and CPSI had engaged in acts or practices in violation of Colorado Bar Association Rules of Professional Conduct. The violations include, but not limited to; engaging in the Unauthorized Practice of Law.

The CSC ordered that Fish and Colorado Paralegal Services, Inc. are enjoined from engaging in the Unauthorized Practice of Law in the State of Colorado and ordered to remove the website www.coloradoparalegalservices.com and request, in writing, that business directories remove their listings and postings about Colorado Paralegal Services, Inc. This decision became effective May 26, 2015.

Comments and Analysis

In the state of Colorado, paralegals cannot practice law nor provide direct legal services to a consumer. The Colorado Supreme Court states that paralegals cannot advertise or otherwise hold themselves out to the general public as being able to provide paralegal services to anyone but a licensed attorney. All of the duties of paralegals are assumed to, and must be, under the direction and supervision of a licensed attorney.

Paralegals are prohibited from providing legal advice to another person, selecting legal documents on behalf of another person, drafting legal documents on behalf of another person, interpreting the law as it may apply to another person’s situation, representing another person in any legal transaction or matter, and prepare another person’s case for trial.
