What's the next step to take?

Date: 3/30/2020 10:48 AM (PST)

I have heard from the business by email and there saying it still stands that the driver says he didn't find anything so they will not be liable to cover my lost. So my question is what's the next step to make, and they haven't replied to you guys.

Hello Clifton. Thank you for your question. I recommend you file a consumer complaint with the Attorney General of Texas (“AG”). Hitch is located in Texas and the AG’s office may be able to offer additional assistance. We did reach out to Hitch twice and did not get a response back. When a company fails to respond to a complaint this is a good indicator that you need to escalate the complaint. By escalating the complaint I mean filing with a state agency or even legal action depending on how far you wish to pursue. Filing multiple complaints with the same agency is futile.

Further, in case you are not aware, on the company’s website, www.ridehitch.com under their terms, https://www.ridehitch.com/terms, it states the following:
As a rider, you agree and acknowledge that any ride or driver services that you order, purchase, participate in or receive is at your own risk and sole responsibility, and you assume all of the risk for any such ride or driver services that you request and procure, and the company is not responsible for any loss, damage, injury or harm that may arise as a result of any ride or driver services that you request, order, purchase, procure, accept, participate in or receive through use of the platform or otherwise.

I can be reached directly at vantillon@checkbca.org if you need additional assistance.

Hello Clifton. I suggest reaching out to the Texas Consumer Protection Division through the Texas Attorney General’s office. They may be able to offer additional assistance: https://www.texasattorneygeneral.gov/consumer-protection/file-consumer-complaint Their website also provided in depth information about what consumer rights are in Texas and what their process is regarding processing consumer complaints.
I wish you the best of luck moving forward.
