Background checks

Me and my daughter recently applied for an apartment. We paid $130 for two background checks and an application fee. The apartment manager got back to us less than 24 hours and denied us. We requested a copy of our background checks but they just gave us a1-800 to call and request them. I don't believe they ran the background checks. What can we do about it?

Hi Serena, thank you for utilizing the BCA Ask the Experts forum. If the landlord refuses to rent to you possibility because of something they found in your background check, then you have rights:
1) The landlord must give you notice of the action – this could be orally, in writing or electronically.
2) The notice must give you contact information for the company that supplied the report.
3) The notice must tell you about your rights to correct inaccurate information and to get a free copy of the report if you ask for it within 60 days of the landlord’s decision.

You should obtain your free report, fix any errors, and have the company that supplied the report re-issue the corrected report back to the landlord. You can also reach out to the landlord regarding the mistakes found.

You can also take preventive measures and check your credit prior to renting, that way you can fix any errors before a prospective landlord sees them.
