Complaint Resolution Index (CRI) Explained The Complaint Resolution Index (CRI) is an indicator on how responsive a company is in addressing and resolving customer complaints brought to their attention by BCA. If they are considering doing business with the company, consumers can use this indicator to forecast the likelihood of having their issues addressed if a problem arises. CRI measures the company's customer satisfaction abilities through BCA’s complaint mediation process.

A variety of factors are considered when calculating CRI. This includes how quickly a company responds to complaints, the number of complaints against a company, whether the company addressed complaint allegations, and the outcome of the complaints. CRI is just a subset of the overall rating for the company. Consumers are encouraged to take into consideration the company's CRI, their overall BCA letter rating and other relevant information about the company so they can make a well-informed purchasing decision.

BCA's Summary and Analysis:

Most complainants allege deceptive and misleading selling practices. Some complainants allege the company promises lower interest rates and payments; however, once the loan modification is received the interest and payments were not as promised. Other complainants allege the company fails to obtain loan modifications, or otherwise provide foreclosure assistance services. Some complainants allege the company repeatedly gave them false or inaccurate information concerning the status of their modification contracts, or that the company fails to return phone calls or otherwise respond to inquiries concerning the status of their foreclosure proceedings. Other clients report unauthorized charges to their credit cards.

The generally company responds to complaints by refusing refunds stating services were provided as contracted and provides explanations of services. The company responds to some other complaints stating they were not paid for the modification however; all responsible parties have been notified of the refund request.

Effective October, 2009 in California, it is illegal to collect any fees, regardless of the form, for negotiating or attempting to negotiate a loan modification for a residential mortgage. All modification services must be fully completed before any money can be collected. It is also illegal to divide fees or services into components for the purpose of avoiding this law.

HUD approved housing counseling agencies are exempt from this law. For businesses outside of California, please check with the agency that regulates this industry.
