In Ms. McComb's most recent complaint, she states her vehicle was repossessed, the contract we have is not the contract she originally signed, and states she was over charged $36,000.00. She claims hse was not permitted to get her car back. She wishes to either get the vehicle, or to receive financial compensation.
The Retail Installment Sale Contract - Simple Finance Charge, a copy of which was previously provided, serves as the official document of record for the validation of this account. Ford Credit is not in a position to attest ot the authenticity of Ms. McCombs signature on our copy of the Retail Installment Sale Contract, versus the copy she states she signed.
If Ms. McCombs contends she did not sign the Retail Installment Sale Contract on file with Ford Credit, it is necessary for Ms. McCombs to solidify her allegation of fraud by completing an affidavit of fraud with Ford Motor Credit Company or by filing a police report. Upon receipt, Ford Credit will investiage Ms. McComb's claim further and notify her of the result of that investigation.
After unsuccessful attempts to reach either Ms. McCombs or Mr. Berry, and with the account being 69 days past the July 15, 2022 due date, the account was charged-off on September 22, 2022. We continued to attempt to contact and collect from Ms. McCombs and Mr. Berry, and the vehicle was eventually repossessed in February 2023. As this was the second repossession of the vehicle and the account was already charged off, the only option available was to redeem this vehicle by paying the palance of $5,410.59, including fees in full, by February 25, 2023.
As the balance owed was not paid, the vehicle was sold at auction and the sale proceeds applied to the outstanding balance on March 9, 2023. Included (to BCA for review) is a copy of the Statement of Sale, which confirms how the proceeds were applied and remaining deficiency balance on the loan. When Ms. McCombs called Ford Credit on March 28, 2023, she was advised on how she could arrange for pick-up of her personal property from the repossession contractor and that she had a remaining balance owed and due of $509.59.
Ford Credit declines Ms. McCombs request to either get her vehicle or her money back. Ms. McCombs may contact Ford Credit at (877) 231-8641 ext. 00706 to discuss the balance owed and request payment arrangements.
