Refund delivery was unnecessarily delayed

March 2013, I received a 'cold call' from this company and I accepted their offer to purchase an extended warranty policy for my vehicle but decided to cancel the policy after 10 days of it being in effect. My policy was cancelled April 19, I was told the amount of the refund, and was advised that the refund should be expected within 30 days of policy cancellation. After not receiving my refund in the expected time frame (by end of May), I contacted the company repeatedly, each time speaking to incompetent service representatives, who refused to escalate my call to the manager or to anyone else to help answer my questions. First, the refund hadn't been issued, and secondly, based on the amount 'in the system', the refund amount had decreased from the original discussion so I was determined to find someone who could reasonably calculate the refund amount for my understanding --- no luck. No service personnel was willing to try to answer my questions or offer to find someone who could. Haphazardly, I stumbled upon Business Consumer Alliance (www.businessconsumeralliance.org) on the web and THANK GOD for that! They intervened on my behalf and resolved the issue. After THREE AND A HALF MONTHS (Aug), I finally got my refund in the expected amount! I am so grateful for their intervention. To those that read this post, I would advise you to not do business with Precise Auto Protection. Granted, they have great salesmanship and offer what seems to be a 'great' policy, but buyer beware. The service side post-sale is absolutely horrible. The reps are unprofessional, unskilled, and unwilling to help you --- Customer Satisfaction is NOT a top priority.

Business Consumer Alliance advises consumers to watch out for unsolicited calls and other communications from individuals who claiming that the warranty on your car is about to expire. Some of the companies behind the letters and calls may even give the impression they represent your car dealer or manufacturer. In most cases these sales pitches are from unrelated businesses that use high pressure sales tactics to get you to purchase an extended warranty or service contract. Most often they will try to press the urgency for you to provide them with personal financial information and a down payment before you get any details about the service contract. ~~If you receive mail or phone calls about renewing your vehicle warranty use caution and don’t take the information at face value. Check to ensure that your vehicle’s is actually expiring or if it may have expired already. You can always check your owner’s manual or contact call the dealership where you purchased the vehicle or the vehicle manufacturer for more information on your warranty. ~~Investigate the offer and don’t give in to high-pressure tactics. Take your time and check out the business before you provide any information to the sales person. Never give out personal financial or other sensitive information such as your bank account or credit card information social security number driver’s license number or Vehicle Identification Number (VIN) unless you know who you’re dealing with. Doing so can lead to identity theft or other methods of fraud. ~

An auto service contract, sometimes called an extended warranty, is a promise to perform (or pay for) certain repairs or service and is not a warranty as defined by federal law. A service contract may be arranged at any time and always costs extra; a warranty comes with a new car and is included in the original price. This separate and additional cost distinguishes a service contract from a warranty.

Before deciding whether to buy an auto service contract find out who backs the service contract? It may be the manufacturer dealer or an independent company. Many service contracts sold by dealers are handled by independent companies called administrators. Administrators act as claims adjusters authorizing the payment of claims to any dealers under the contract.

Costs will vary based on your car's recommendations for routine maintenance such as oil and spark plug changes. Failure to do so could void the contract. To prove you have maintained the car properly keep detailed records including receipts. Find out if the contract prohibits you from taking the car to an independent station for routine maintenance or performing the work yourself. The contract may specify that the selling dealer is the only authorized facility for servicing the car.

California law outlines specific requirements for service contract sales. One of the requirements is that sellers must make the contract available for inspection by the buyer prior to purchase and either the contract or a brochure which specifically describes the terms conditions and exclusions of the contract and the provisions of the code relating to contract delivery cancellation and refund be delivered to the buyer at or before the time of purchase of the contract. In addition the code section further outlines that service contract sellers may assess a cancellation or administrative fee not to exceed 10 percent of the price of the service contract or twenty-five dollars ($25) whichever is less. Make sure you read and thoroughly understand the agreement and check that all verbal promises have been included. Do not sign a contract with blank spaces that could be altered or changed. Finally once the contract is signed keep a copy of it for your records.
