I have received notice of your posted concerns here and was able to locate your claim file with the details you provided. I will do my best to provide you with clarification. I see it noted in your claim file that you received a SafeMove denial from handling adjuster regarding damages to your television. Denial was for SafeMove coverage as there is a specific Exclusion for not covering improper packing/shifting of cargo in-transit. I see you spoke to our VP of Claims per escalation phone call where he inquired as to whether you were involved in an accident/collision, rollover, fire, upset or overturn of the equipment which would have triggered the SafeMove coverage but you advised No. You stated that the issue was the road, and that television was the only item that was damaged. You informed the VP that the rental facility and team members advised you there would be coverage for his television. You alleged that a U-Haul rep told you to contact us and get his claim started as "there would be coverage", but as stated unfortunately that would only be the case if there was valid SafeMove coverage and it was triggered with the stated collision, fire or overturn accident. When the VP looked at the rental contract, he saw a Customer Action File (CAF) informing that Mr. Baker had declined SafeMove coverage at the rental dispatch. CAF Reference id: 4660119. During the CAF call, it was noted that the U-Haul Team Member Refunded back to customer credit card the amount of Refund $60.00. Due to above, that you were refunded the equivalent of what the SafeMove coverage amount would be, and there was No SafeMove coverage purchased, you would not be entitled to the protection benefits under SafeMove. But as stated previously, even if the SafeMove coverage had been purchased, the claim denial would stand on the contract Exclusion reason of shifting, since you stated that you were not involved in any collision accident. Insurance company name: Repwest Insurance Company Claim #03249575-2023 On Saturday, September 9, 2023, at 12:41 AM in 81st Ave. between 88 street and Myrtle Ave unmarked NYPD police van was chasing a suspect who was driving U haul van plate # AL 37972 state of Register AZ (Arizona). Name of driver Elijah Rivera. The suspect tried to flee away from the police, so he drove on the sidewalk and crashed into my house located at 87-44 81st Ave Glendale, NY 11385 caused damage to my house steps, metal guardrail and siding and drove away. The police kept chasing him then he crashed into another car in the same block. Attached is the police report stating the damage to my house. Accident police # 2023-104-001230 Precinct 104 NYC I have two videos shows the police chasing the U-Haul van while it's driving on the sidewalk and the police chasing while driving on the road. On front of my house there was a tree making the sidewalk narrow making it impossible to drive through, So the U-Haul driver crashed into my home break steps and broke it, Crashed into my metal guardrail broke it into pieces and crashed into my house siding caused damage to the siding. Resolution Sought Get my claim approved and get reimbursed for the damages to my house.

Please be advised that there is no bond nor policy available of liability insurance provided by Repwest Insurance Company. We handle claims under the minimum financial responsibility (MFR) limits of each state jurisdiction where the loss occurred. As such, this letter is in response to the above captioned matter. We have received and reviewed the BCA complaint filed by Mr. Mourkos. We have completed our Coverage Investigation of this claim. Due to the fact pattern and police matter leading up to the collision, it was confirmed, there is No coverage for this claim. Accordingly, a coverage denial letter was issued. The u-haul driver caused the collision not the police. The police was just following him to pull him over. The driver decided to drive on the sidewalk instead of complying with police orders to stop. Therefore the damaged caused by the u- haul van must be covered by U-haul insurance. Since it’s the u-haul driver’s fault.
