As of January, 2010, all talent services in California are required to file a bond with the Labor Commissioner in the amount of fifty thousand dollars ($50,000) or a deposit in lieu of the bond prior to advertising or engaging in business. Talent agents also require a separate agency license in addition to the bond requirement.

Advance Fee Talent Representation Services (AFTRS) are prohibited by California law. Generally this means that it is unlawful for such a service to offer to provide, either by itself or by referral to someone else, service as manager or director of the development of an artist’s career, or procurement of (1) a talent agent or manager, (2) an employment opportunity, or (3) an audition or engagement as an artist if the service charges a fee for any of these services or for (1) photographs, websites, or any other reproductions or promotional materials, (2) lessons, coaching, seminars, workshops, or similar training, or for (3) any other product or service required to obtain any of these services either from or through the AFTRS.

Other kinds of talent services are not prohibited and may charge fees. These include the following services:

Talent Listing Services, which may charge a fee to provide an artist, either themselves or by referral to someone else, with (1) a list of auditions or employment opportunities, (2) a list of talent agents or talent managers, or their representatives, (3) a database search of audition or employment opportunities or talent agents or talent managers, (4) storage of such information and materials as the artist’s name, photograph, website, filmstrip, videotape, resume, portfolio, other reproduction or promotional material, or a schedule of availability of the artist for an audition or employment opportunity.

Talent Counseling, Listing and Training Services are required to comply with certain legal requirements with regard to their contract provisions, including information about your right to cancel the contract within 10 business days from the date you sign or begin using the services described in the contract, and to be bonded.
